The following Terms and Conditions of Maharaj’s Coaches (“Maharaj’s”) govern your use and access of this web site ("Site"), and the information, materials, features or services accessible from this Site. By visiting maharajscoaches.co.za or using any of its information, materials, features or services, including but not limited to any reservation or ticketing services, you are accepting these Terms and Conditions and the associated Privacy Policy. If you do not agree with these Terms & Conditions, you may not access this Site.   


Sightseeing Tour Refunds and Cancellations.  

Cancellations must be made Thirty (30) days prior to the schedule departure of the trip. Cancellations that are received by the deadline will receive a full refund of any and all monies that have been paid towards the charter up until the date of cancellation. Cancellations received less than Thirty (30) days prior to the schedule departure of the trip will result in a loss of all monies that have been paid toward the trip.    

NO REPRESENTATIONS AND WARRANTIES

Neither Maharaj’s nor its affiliated entities warrant or make any representations of any kind with respect to the materials and information contained on this Site. Your use of this Site is at your own risk. Although Maharaj’s attempts to provide accurate information, this Site is intended to be for general reference and informational purposes only. Although we strive to keep this Site up to date, it may contain inaccurate, incomplete, or out-of-date information. Maharaj’s assumes no responsibility for errors or omissions in the content of this Site, and makes no commitment to update such information. Your sole and exclusive remedy against Maharaj’s for issues relating to the use of, or the material on, this Site shall be to discontinue accessing this Site or using the information, features, material or services obtained. MAHARAJ’S COACHES'S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE MINIMUM AMOUNT ALLOWED BY APPLICABLE LAW. THIS LIMITATION IS MAHARAJ’S COACHES'S CUMULATIVE TOTAL LIABILITY FOR ANY AND ALL LIABILITY TO YOU OR ANY OTHER PARTY FOR ANY LOSS OR DAMAGES RESULTING FROM ANY CLAIMS, DEMANDS OR ACTIONS ARISING OUT OF OR RELATING TO THIS AGREEMENT, THIS SITE, OR ANY INFORMATION OR MATERIALS ACCESSIBLE ON OR FROM THIS SITE.

INDEMNITY

YOU UNDERSTAND THAT YOU ARE PERSONALLY RESPONSIBLE FOR YOUR BEHAVIOR WHILE ON THIS SITE AND AGREE TO INDEMNIFY AND HOLD MAHARAJ’S COACHES, ITS SUBSIDIARIES AND AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, HARMLESS FROM AND AGAINST ANY LOSS, DAMAGE, LIABILITY, COST OR EXPENSE OF ANY

KIND (INCLUDING ATTORNEYS' FEES) THAT WE MAY INCUR IN CONNECTION WITH A THIRD PARTY CLAIM OR OTHERWISE, IN RELATION TO YOUR USE OF THIS SITE (INCLUDING POSTING OF ANY CONTENT) OR ACCESS TO THIS SITE, OR YOUR VIOLATION OF EITHER THESE TERMS OF USE OR THE RIGHTS OF ANY THIRD PARTY.

REQUIRED CONDUCT

Maharaj’s requires that you agree to follow the following basic rules of conduct when using this Site:

(1) You will follow these Terms & Conditions and all applicable laws;

(2) You will only provide truthful and accurate information;

(3) You will not harass, threaten or abuse other people when using this Site in any manner;

(4) You will not interfere with others' use of this Site, including by interrupting other users' sessions, or otherwise act in a way that negatively affects other users' use of this Site;

(5) You will not post any content that is obscene or may be hateful or offensive on racial, ethnic, sexual or any other grounds; is harmful, vulgar or distasteful; or is defamatory, libelous, or invades another person's privacy or proprietary rights;

(6) You will not collect or store personally identifiable information about any other individual on this Site, or otherwise stalk, repeatedly contact or harass another user;

If any term of this Agreement is declared unlawful, void or for any reason unenforceable by any court in any jurisdiction, then such term will be deemed severable from the remaining terms in such jurisdiction and will not affect the validity and enforceability of such remaining terms.

HEALTH, SAFETY AND ENVIRONMENT

HEALTH, SAFETY AND ENVIRONMENT POLICY

Health, safety and environment is of foremost importance in conducting our business activities, therefore the Company will endeavor to protect the Health and Safety of its employees, customers and members of the public who may be affected by its activities and to limit adverse effects on the physical environment in which it operates.

We believe that:

All accidents can be prevented.ØEvery job can be done safely.ØLine managers are responsible for the safe environment of those they control.ØEveryone has a duty to work safely, to be health conscious, environmentally aware and to encourage others to do likewise.Company Policy Objectives:

To provide a Health. Safety and Environment Programme to protect our employees and the environment.ØTo ensure that all Employees and Contractors are properly informed of their responsibilities for Health, Safety and Environmental matters and comply with Safe Working Procedures and thus create a safe place to workØActively promote the establishment of sound and workable H.S.E. codes of practices and statutes and transfer H.S.E. know-how to our customers.ØIt is the duty and responsibility of every employee to take appropriate care for the Health Safety of himself, and of fellow workers and any other person who may be affected by his or her actions.ØStimulate interests and enthusiasm towards safe and healthy working, therefore management seeks and encourages employees involvement and commitment to the Company’s Health, Safety and Environmental and quality programme.

DRUGS AND ALCOHOL POLICY    

In line with the Company's Disciplinary Code and the Occupational Health and Safety Act and the Road Traffic Act our Company commits itself to 0% alcohol and drug level for its entire staff.

It is the Policy of the Company to protect both the employees and the Public by implementing a Zero Tolerance Policy on the Intake of Alcohol and Drugs by its staff.

As an effective control measure, we reserve the right to carry out regular and random tests on any member of the staff.

This will be done by using an approved testing device which will be regularly checked by the supplier. Those administering the check will be trained in the use of the equipment.

Any person whose function may be impaired due to use of drugs or alcohol will be suspended immediately and will be subject to a disciplinary enquiry.

 HIV AND AIDS POLICY

The purpose of this Policy is to ensure that all people who deal with the Company are treated with dignity, irrespective of the fact that they are HIV positive or have Aids.

The Company recognises the fact that all persons with HIV or Aids have a legal right to privacy. Where an employee chooses to voluntarily disclose his or her HIV status to the Company or other employees of the Company, this information may not be disclosed to other without the employee's express "written consent".

It is the Company's policy to encourage openness, acceptance, and support for those employees who voluntarily disclose their HIV status within the work place.

No person with HIV or Aids shall be unfairly discriminated against within the employment relationship or within any employment policies or practices.

The company promotes a non-discriminatory work environment, based on principles of equality and non-victimisation.

The Company will endeavour to accommodate an infected employee so that he/she is able to work for as long as he/she is medically able to, within the parameters of the operational requirements of the Company and what is reasonable in the circumstances.

SAFETY POLICY

1 PURPOSE

To ensure safe working condition and practices and to regulate the issuing of equipment and protective wear.

2. POLICY

2.1 Safety Policy

2.1.1 Management believes that:     

    Safety requires a willing a co-operate attitude for all;    

    Accidents decrease production, increase cost and disrupt the     family life of employees;   

    Matters of safety warrant top priority over matters of production,     quality or efficiency;   

     he correction of deviation from safety rules and procedures     warrants firm and consistent discipline.   

2.1.2 Management will organize appropriate training from time to time in:   

    Safe working practices;    

    Fire prevention & Fighting; and health and Hygiene   

2.2 Safety Equipment & Protective Wear Policy

2.2. Two overalls or dust coats and two printed t-shirts will de issued to employees in a cycle of 18 (eighteen) months;2.2.2Employees will be expected to launder and maintain protective clothing issued to them;2.2.3Employees will be expected to wear protective clothing issued and ensure that these are clean and presentable; and2.2.4Failure to wear protective clothing and safety equipment issued is an offence and can lead to disciplinary action.    

SECURITY POLICY 

Our aim is to protect the Safety, Health and Security of our staff, neighbours, visitors and customers to our premises, ensuring that no harm, damage or loss is caused to our assets and property by intentional destruction or theft    

We undertake to: 

a) Implement procedures that shall be fair and within labour practices.

b) To invest in infrastructure, technology and systems and human resources needed for the efficient function of the security policy

c) Work with our customers, security associations and the law enforcement agencies to enhance our standards.

d) Comply with the provisions of the relevant National Occupation, Health & Safety Legislation.

e) To routinely assess the risks and develop processes to ensure the security risks are effectively managed.

f) To continuously educate that staff that they are responsible for the safety of themselves, customers and staff as well as the company assets and property.

g) To continually evaluate the security performance on regular basis.

SECURITY  

Customer satisfaction is directly related to comfort, security, cleanliness and reliability ofALL vehicles therefore, at Maharaj's Coaches we conduct our own internal Preventive MaintenanceProgramme. These programmes are designed to ensure optimal performance and roadworthiness of vehicles and to maintain passanger safety.   

When ever travelling on Maharaj’s Coaches feel assured that we always maintain strict adherence to company policies to best safeguard you and your possessions whilst on the bus.
